“Solving legal problems is something I see as my task and challenge. After all, there's a solution to every problem.”
“Solving legal problems is something I see as my task and challenge. After all, there's a solution to every problem.”
Background:
In 1990, I began my legal career in Zwolle at the Law Firm Benthem & Gratama, where I worked as a lawyer in general practice. Over time, I increasingly focused on corporate law and bankruptcy law. In 1998, I moved to the Law Firm Van der Steenhoven in Amsterdam, where I became partner in 2002. Since 2007, I have been a partner at CERTA. I am a member of the specialist associations INSOLAD and VIA, and I have completed the specialist training to become a restructuring expert under the WHOA.
I can assist you with matters that fall under:
General corporate law: This area covers legal issues such as conflicts between shareholders, acquisitions, decision-making within the company, and (commercial) contracts. My work involves not only drafting contracts but also handling disputes concerning their performance.
Insolvency law: I am regularly appointed as a receiver in bankruptcies and as an administrator in suspensions of payment. Additionally, I advise creditors and other parties involved in matters such as the enforcement of securities. Since 2021, I have also provided advice regarding the WHOA.
Directors’ liability: I handle cases from both perspectives—defending directors (including supervisory directors or shareholders) who are held liable and representing creditors who, beyond seeking payment from their direct debtor, may wish to take action against other responsible parties.
Debt collection plus: I lead the debt collection team at CERTA, which manages the debt collection process in a broad sense. Thanks to the combination of collection specialists and lawyers within one team, we handle the entire process, from the out-of-court phase to legal proceedings.
